Public procurement in Spain
ESPD and DEUC in Spain
DEUC is the Spanish name for the European Single Procurement Document (ESPD). It is a preliminary self-declaration for the tender process, not proof that the authority has approved your eligibility.
Use the request for this tender
Follow the contracting authority’s form and instructions. Check operator identity, representation, exclusions and selection criteria; do not reuse an old declaration without updating it.
Separate participating entities
Joint bids and reliance on other entities can require separate declarations and commitments. Check each entity’s role and the tender requirements before combining information.
Keep evidence ready
The authority can request supporting documents under the applicable rules; do not wait until the end to find certificates and references. A self-declaration does not remove the need to meet the actual requirements.
Complete the form requested by the authority
Identify the procedure and lots first. Use the authority’s supplied request or form and follow its instructions for the selection-criteria sections. A generic saved ESPD may contain answers for a different procurement or an outdated company position.
Prepare operator identity, representation, exclusion information and evidence of standing. Check whether the authority asks for a global indication of compliance or detailed answers. Do not leave a section blank merely because the same fact appears in another document.
If your bid is joint, or relies on another entity’s capacity, identify each participant and the declarations or commitments required. A supplier, subcontractor and capacity-providing entity are not interchangeable roles. Make the form consistent with the actual arrangement and with the evidence you can later provide.
Keep a supporting-evidence register
For each declaration, record the certificate, accounts, reference or authorisation that supports it, who holds the document and when it expires. Check equivalent evidence and translation requirements for your country with the tender instructions. The declaration is preliminary; it does not remove the underlying obligation to meet the criteria.
LCSP Article 140.3 permits requests for supporting documents during the procedure in its stated circumstances. Do not assume that only the eventual winner may ever be asked for them. Prepare evidence early enough to respond within a real request’s deadline.
Illustrative example: a company relies on another operator’s experience for part of a service. Declaring that it meets every condition alone and attaching a vague support letter later may not describe the arrangement correctly. Review the relevant entities, commitments and execution roles before signing. Keep the signed form and the submission receipt together.
Frequently asked questions
Is DEUC different from ESPD?
DEUC is the Spanish name for the European Single Procurement Document.
Does the form replace supporting evidence permanently?
No. Evidence can be required under the applicable rules, including during the procedure in the circumstances of LCSP Article 140.3.
Can every member of a joint bid use one declaration?
Check the declarations required for each participating or capacity-providing entity. Do not conceal their separate roles in one generic response.
